Gary M. Gilbert, Esq. |
In May 2005, Gary Gilbert opened his practice in
Silver Spring, Maryland. Prior to the opening
of Gary M. Gilbert, PC, Mr. Gilbert was "Of Counsel" to the Washington DC
employment law firm of Passman & Kaplan, P.C.,
from February 11, 2002 through December 31,
2005. Immediately prior to this position, Mr. Gilbert was the Chief Administrative Judge in
the Baltimore District Office of the Equal
Employment Opportunity Commission. In that
position he supervised the conduct of
administrative hearings held pursuant to Title
VII of the Civil Rights Act of 1964, Age
Discrimination in Employment Act and the
Rehabilitation Act of 1973. Judge Gilbert is a
member of the Labor and Employment Section
Council of the Maryland Bar Association. He has
spoken and written extensively on various
aspects of employment discrimination law and has
been active in the Commission's training for
Administrative Judges in the federal sector and
in training on the Americans with Disabilities
Act for investigators and attorneys in the
private sector. Recently he served on the
Commission’s inter-office workgroup responsible
for coordinating the implementation of the
proposed revisions to the Commission’s
regulations. His most recent publication, titled
“Compensatory Damages and Other Remedies in
Federal Sector Employment Discrimination Cases”
is an exhaustive review of the damages available
to victims of employment discrimination.
Prior to his years with the EEOC, Administrative
Judge Gilbert was a project director with
Florida Rural Legal Services (F.R.L.S.), one of
the largest legal services programs in the
country. He briefly served as the Acting
Executive Director for Florida Rural Legal
Services. He also spent several years with the
United States Nuclear Regulatory Commission as a
legal assistant to the Secretary of the
Commission. He is admitted to the bar in the
States of Maryland and Florida.

Linda A. Kincaid, Esq. |
Of Counsel, Linda Kincaid works as a senior attorney
with the Law Offices of Gary M. Gilbert, P.C. She also
serves as an Appellate Judge and Hearing Officer for the
Office of Compliance, U.S. Congress. She is a member of
the Bars of the States of Georgia and Maryland and of
the District of Columbia. She also is admitted to
practice before the U.S. Supreme Court and a number of
federal courts. She is certified as a Mediator in
Maryland
For 21 years, from 1984 through February 2005 when she
retired from the EEOC, Ms. Kincaid served as an
Administrative Judge. While employed by the EEOC, she
adjudicated hundreds of individual discrimination cases,
conducting hearings and mediations and rendering
Decisions on those cases filed under the Civil Rights
Act, the Age Discrimination in Employment Act, the Equal
Pay Act and the Rehabilitation Act. Additionally, while
at the EEOC, Ms. Kincaid presided over significant class
action cases resulting in Settlements awarding millions
of dollars and benefits for members of the classes and
significant modifications to policies of employers. Ms.
Kincaid also has conducted training of administrators
and attorneys in the federal and private sectors. In
addition, she serves as a Director of the Federal
Employment Law Training Group, Inc.

Alesia Peterson, Esq. |
Managing Attorney, Alesia Peterson
is admitted to practice law in the
District of Columbia and the state
of Illinois (inactive), as well as,
before the United States Court of
Appeals for the Federal Circuit and
the United States Patent & Trademark
Office. Ms Peterson graduated from
American University’s Washington
College of Law and also holds a
Bachelor of Science from the
University of Maryland, College
Park.
Prior to joining Gary M. Gilbert &
Associates, Ms. Peterson worked in
the Office of Unfair Import
Investigations at the International
Trade Commission as a staff
attorney. Her private practice
experience includes patent law
litigation with the law firm of
Cushman, Darby & Cushman, and patent
prosecution with the law firm of
Finnegan, Henderson, Farabow,
Garrett & Dunner.

Kevin Owen, Esq. |
Associate
Attorney, Kevin Owen is admitted to
practice law in the state of
Maryland and before the United
States District Court for the
District of Columbia, the United
States District Court for the
District of Maryland, the United
States Court of Appeals for the
Fourth Circuit, and the United
States Court of Appeals for the
Federal Circuit. Mr. Owen graduated
with honors from American
University’s Washington College of
Law and also holds a Bachelor of
Arts degree in Political Science and
Criminal Justice. While in law
school, Mr. Owen served as the Note
& Comment Editor for the American
Bar Association’s Administrative Law
Review and was the recipient of the
Don Monroe Casto Award for
Outstanding Constitutional
Scholarship.
Prior to joining the practice with
the Law Offices of Gary M. Gilbert &
Associates, Mr. Owen served as a law
clerk for the Office of Legal
Counsel of the United States Equal
Employment Opportunity Commission
and for the Office of General
Counsel of the National Employees
Treasury Union (NTEU).

Lei Hart, Esq. |
Associate
attorney, LeiLani J. Hart is
admitted to practice law in the
state of Maryland and before the
United States District Court for the
District of Maryland. Ms. Hart
graduated with honors from American
University’s Washington College of
Law and also holds a Master of
Business Administration and Bachelor
of Science from George Washington
University where she played Division
I basketball. While in law school,
Ms. Hart worked on the Journal of
Gender, Social Policy & the Law. She
is a member of the Maryland Bar
Association.
Ms. Hart assisted Mr. Gilbert in
researching and writing portions of
the 2008 EEO Update, for which Mr.
Gilbert serves as the primary
author.

| Katherine R. Atkinson, Esq. |
Associate
Attorney, Katherine R. Atkinson is
admitted to practice law in the
state of Maryland and before the
United States District Court for the
District of Maryland. Ms. Atkinson
graduated from American University’s
Washington College of Law and also
holds a Bachelor of Arts in Foreign
Service from Georgetown University.
While in law school, Ms. Atkinson
served as a note and comment mentor
for the Journal of Gender, Social
Policy, and the Law and interned for
the Honorable Gerald Bruce Lee in
the United States District Court for
the Eastern District of Virginia.
Ms. Atkinson is an adjunct professor
of law at the University of
Baltimore’s School of Law and an
Adjunct Instructor with the Federal
Employment Law Training Group, as
well as, a member of the National
Employment Lawyers Association, the
Metropolitan Washington Employment
Lawyers Association, and the
American Bar Association. She
assisted with the writing of several
of Mr. Gilbert’s books, including
the Disability Discrimination Law
Deskbook and Compensatory Damages
and Other Remedies in Federal Sector
Employment Discrimination Cases.
In 2006, Ms. Atkinson played an
instrumental role in a
ground-breaking Department of
Agriculture victory in a sexual
harassment case. Ms. Atkinson’s
argument that the Agency was
entitled to the Farragher/Ellerth
affirmative defense was successful
on summary judgment before an
administrative judge and on appeal
to the Commission (EEOC Appeal No.
01A60388).
In 2007, Ms. Atkinson co-authored an
article analyzing the various county
employment discrimination statutes
in Maryland for Trial Reporter, the
publication of the Maryland Trial
Lawyers Association.

Benjamin E. Wick, Esq. |
Of Counsel,
Benjamin Wick is admitted to
practice law in the states of
Maryland and Colorado. Mr. Wick
graduated Magna Cum Laude from
American University’s Washington
College of Law and also holds a
Bachelor of Arts from the University
of Colorado. He is a member of the
Maryland Bar Association and
Colorado Bar Association, as well

Attorney, Stephanie Herrera is

Associate
Attorney, Deryn Sumner is admitted

University of Southern California.
